Remote hires and document examination
For employees who are not at a company location, the method used to examine documents matters. DHS permits an optional alternative procedure for remote examination only when an employer meets its conditions, including participation in E-Verify in good standing. Employers can also use an authorized representative to conduct an in-person examination on their behalf.
I-9 Pro is Mitratech’s managed option for remote-hire verification. In the DHS-authorized alternative procedure workflow, an eligible employer can have a new hire schedule a live video appointment after completing Section 1. An I-9 Pro representative reviews the documents and completes Section 2 on the employer’s behalf. Ask the team to demonstrate the service and explain its current configuration and scope.
If an employer does not qualify for the DHS alternative procedure, it must use an applicable in-person examination process, including an authorized representative if appropriate. The examination method must follow the applicable requirements regardless of the service selected.
What to ask about SOC 2 and data security
SOC 2 is an independent auditor’s report on controls at a service organization, assessed against selected AICPA Trust Services Criteria. Its scope matters: a report for one product or environment does not automatically cover another.
When evaluating Mitratech I-9 Compliance solutions, request the current security documentation and ask whether a SOC 2 report covers the Mitratech I-9 platform and the specific service you plan to use. If a report is available, review whether it is Type 1 or Type 2, its reporting period, the Trust Services Criteria in scope, any exceptions, and the auditor’s opinion. You can also ask the security team to explain encryption, access controls, and the process for providing records during due diligence.
Frequently Asked Questions About Mitratech I-9 Compliance and Security
How do Mitratech I-9 Compliance solutions support Form I-9 compliance?
The workflows are designed to support applicable Form I-9 requirements, including requirements for electronic completion, signatures, recordkeeping, and inspection. Employers remain responsible for accurate completion and for evaluating how the system is configured and used. Mitratech does not claim USCIS approval or certification of the platform.
Does Mitratech I-9 integrate with E-Verify?
Yes. Mitratech’s platform provides an integration for participating employers to create and manage E-Verify cases within the I-9 workflow. This is an integration with a federal program, not a government certification of the software or its customers.
How can I review the security documentation?
Ask our security team for the current documentation covering the platform and service you plan to use. If a SOC 2 report is available, confirm the service in scope, report type, reporting period, Trust Services Criteria, and auditor opinion. SOC 2 is an attestation report, not a product certification.
Does Mitratech I-9 support remote hires?
Yes. I-9 Pro is Mitratech’s managed Section 2 verification service for remote hires. For eligible employers using the DHS alternative procedure, it supports a live video appointment. The appropriate examination method depends on the employer’s E-Verify status and applicable DHS requirements.
Does Mitratech I-9 provide audit support?
Yes. Mitratech offers tiered audit support and legal consultation, from records preparation through direct communication with ICE agents, for employers that receive a Notice of Inspection.
How can Mitratech I-9 help prepare records for an inspection?
Mitratech’s recordkeeping tools help employers locate and organize Forms I-9 and related activity records for an inspection. General Support can answer product-use questions. The employer and its counsel are responsible for the legal response to a Notice of Inspection.
How does Mitratech I-9 protect candidate and employee data?
Ask our security team about the controls used for the Mitratech environment, including encryption, user access, activity logging, and available independent assurance documentation. Review the scope of any report against the service you plan to purchase.
Does using Mitratech I-9 guarantee an employer will avoid an ICE fine?
No. Outcomes depend on the accuracy of the employer’s forms, the way its process is administered, and the records available during an inspection. Mitratech provides workflow and recordkeeping tools, but no software can guarantee an audit outcome.
What questions can Mitratech Support answer?
Mitratech’s general Support team helps with product-related questions about using the platform. It does not provide legal advice or case-specific compliance guidance. For those questions, employers should consult their own legal counsel.
What should employers compare when evaluating I-9 software?
Ask each provider to demonstrate Form I-9 completion, error review, E-Verify case handling, record retrieval, access controls, and remote-hire workflows. Request current security documentation and a clear description of audit-response services.
Is E-Verify required for employers using Mitratech I-9?
No. Employers can use Mitratech’s Form I-9 management features without enrolling in E-Verify. Employers that choose or are required to use E-Verify must follow the program’s enrollment and use requirements.
