Given the recent devastation that Hurricane Laura has brought, OFCCP Director Craig Leen published a memorandum granting limited extension and waiver from some requirements within contracts for hurricane relief efforts. These efforts relate to obligations under Executive Order 11246, Section 503 and Section 4212 of the Vietnam Era Veterans’ Readjustment Assistance Act (VEVRAA) for a 3-month period from August 27, 2020 to November 27, 2020.
The Equal Employment Opportunity (EEO) clauses may be modified in terms of developing the affirmative action program, preparing reports or providing notices usually required under the regulations implementing EO 11246, Section 503 and VEVRAA. Requirements that must continue to remain in compliance include:
- Posting of the “Equal Opportunity is the Law” notice
- Recordkeeping and record retention
- Employment listings with the appropriate local employment service office
- Nondiscrimination and non-retaliation requirements at 41 CFR 60-1.4(a)(1), 41 CFR 60-300.5(a)(1), and 41 CFR 60- 741.5(a)(1)
- Processing of complaints of discrimination under 41 CFR 60-1.21-1.24, 41 CFR 60-300.61 and 41 CFR 60-741.61
- Obligation to comply with other laws
