Announcing a New LCA Feature for our Immigration Solution
Launching in January 2020? A new module for our ImmigrationTracker™ solution that will enable immigration professionals to electronically post and maintain their clients’ Labor Condition Applications (LCAs – used in H-1B and PERM cases) and related Public Access Files (PAFs).
The LCA serves to notify all “affected” employees of an employer’s plans to hire foreign workers, to help ensure those workers don’t displace US employees.
Compliance under federal policies has become increasingly complex, with heavy scrutiny from the Department of Homeland Security (DHS) and Department of Labor (DOL). Employers and their counsel are seeking technology that will prevent mistakes and automate the LCA posting while helping guide legal staff and HR through the H-1B process which is changing considerably in 2020.
Based on the latest guidance
To address this need, the Tracker team developed a solution that adheres to guidance promulgated by DOL in March 2019 for electric posting and notifications. Existing customers of ImmigrationTracker™ who request the new electronic LCA module will not require any new installation, as they already have LCA data and HR access rights in their existing platform. Law firms will be able to securely and remotely post LCAs for clients, with a custom site per corporate client (and each third-party worksite).
Case preparers can use Tracker’s exclusive eMerge™ functionality for one-click digital assembly of multiple documents into a single PDF, to generate a full Public Access File, which the system maintains for each employer. The new module auto-expires LCA postings after 10+ days (as scheduled) and auto-notates the client file.
